1. Agreement to Terms

By accessing or using services provided by IKR Media, you agree to be bound by these Terms & Conditions.

If you do not agree, do not use our services.

2. Services

We provide access to marketing systems, CRM tools, automation workflows, AI-powered features, consulting, setup services, and optimization services.

All services are subject to:

• Usage limits
• Scoped deliverables
• Plan restrictions

3. No Guarantees

We do not guarantee specific results, revenue increases, lead volume, or conversion rates.

Results depend on factors including:

• Client implementation
• Data quality
• Lead sources
• Market conditions
• Compliance with laws

4. Payments, Billing & Subscriptions

All fees are billed in advance.

Subscription fees recur automatically immediately after any applicable trial period ends.

Subscription may be cancelled at any time by the client via the client portal or by requesting assistance by our support team (cancellations requested or made within 72 hours of billing may not be completed on time).

Setup fees & processed payments are non-refundable.

Failure to pay may result in suspension or termination.

Pricing may change without prior notice (billing will not continue until agreed by client).

5. Refund Policy

Unless explicitly stated in writing:

• Setup fees are non-refundable
• Subscription fees are non-refundable once billed
• Custom services are non-refundable after work begins

6. Usage Limits & Fair Use

Accounts may be subject to additional fees and/or limits on:

• Contacts
• Messaging volume (SMS/email)
• Automation executions
• User access

Exceeding limits may result in additional fees, service restrictions, or required upgrades.

7. Client Responsibilities

You agree to:

• Provide accurate information
• Obtain proper consent from your contacts
• Comply with all applicable laws, including TCPA, CAN-SPAM, and California privacy laws
• Use systems ethically and legally

8. Prohibited Use

You may not use our services to:

• Send spam or unsolicited messages
• Violate privacy or consumer protection laws
• Engage in fraudulent, deceptive, or abusive practices
• Transmit malicious code or content

Violation may result in immediate termination without refund.

9. Intellectual Property

All workflows, templates, systems, and materials remain the intellectual property of IKR Media LLC unless otherwise agreed in writing.

10. Limitation of Liability

To the maximum extent permitted under California law, IKR Media, LLC shall not be liable for indirect, incidental, or consequential damages. Total liability shall not exceed the amount paid by you in the previous 30 days.

11. Termination

We reserve the right to suspend or terminate services for:

• Non-payment
• Policy violations
• Abuse of system resources
• Legal or compliance concerns

12. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles.

13. Changes to Terms

We may update these Terms at any time. Continued use of our services constitutes acceptance of updated terms.
